What is a copyright?  The Copyright Law (U.S. Copyright Act) provides protection against reproducing a copyrighted work “in whole or any substantial part and by duplicating it …exactly or by imitation or simulations,” without permission of the photographer.    

 Who owns the copyright to a photograph?  Under the law, a photographer owns the copyright to work that he or she has created.

 How long does the copyright last?  The copyright commences at the time of creation of the work and retains copyright for his/her life plus fifty years.   

 All our images are copyright protected, which means we, Gail Molyneaux Photographics, own and control the rights to all images whether they are printed photographs or images on our website.  Therefore, it is unlawful to reproduce or duplicate images in any form, by any means, without the written permission of Gail Molyneaux Photographics.

 Without prior written permission from Gail Molyneaux Photographics, our images may not be used for any business, advertisement, digital imaging, and presentations or in publications, et.al.  No images may be reproduced, photocopied, digitally altered, enhanced, by any form or means; nor in any way may the images be transferred onto cards, calendars, shirts, hats, and plates or released on the Internet et.al.  Don’t rationalize that you are helping the copyright owner by advertising their work for FREE.

 Infringements of the U.S. Copyright Law will be prosecuted in the United States Federal Court where you may be subject to paying Statutory Damages in the amount of $150,000 as well as court costs and attorney’s fees. 

 If you need to use a photograph or image for purposes other than hanging it on your wall and enjoying the memory, please contact us.  Infringement of a copyright is not only against the law but it also takes away from my means of making a living, just as surely as if I took away part of your paycheck from your employment.  If you enjoy my photographs on your wall or in an album, then do not take away my means of getting to the next rodeo or capturing a special moment.
